The Supreme Court of India in the case of Iqbal Ahmed (Dead) by LRs. & Anr. v. Abdul Shukoor has ruled that Appellate Courts must consider the pleadings of parties before admitting additional evidence under Order XLI Rule 27(1) CPC. The Court emphasized that additional evidence cannot be the basis for reversing a decree without proper pleadings to support it, setting aside the High Court’s judgment and remanding the case for fresh consideration
