The Hon’ble Supreme Court in the case of Kalyan Dey Chowdhury Vs. Rita Dey Chowdhury Nee Nandy1 has held that 25% of the income ought to be taken for the purpose of assessing the maintenance payable to the wife. In that view of the matter, the maintenance awarded by the Family Court will have to be suitably enhanced by directing that the respondent to pay a sum of ₹20,000/- to the first petitioner/wife and a sum of ₹15,000/- to the second petitioner/daughter from the date of the petition up to date. The respondent is also liable to pay the educational expenses of the daughter apart from the maintenance that is liable to be paid
